Additional Costs
By the term ‘Additional Costs’ we mean those costs which were not expected in the initial estimate of costs but now arise because a new issue in the case has arisen. An additional cost will have two parts to it:
(a) The item of external expenditure (called a ‘disbursement’) – say the cost of an expert report.
(b)The extra-legal work (the barrister’s fees) which the new item requires to be done – here it will be the cost of finding and briefing the expert, discussing the draft report, plus any further costs which the report brings as a consequence, such as having to amend the claim.
What sort of additional costs might arise?
Needing a new expert.
Amending the claim because of new information.
Proofing an Additional witness.
Second meeting with an expert.
Dealing with new documents.
Insufficient court time causing the court to have to relist.
The additional travelling expenses of the extra witness or expert.
